Aquarium Setup and Cleaning Service Disclaimer

Scope of Services
Our aquarium services include setup, cleaning, water changes, equipment checks, and general maintenance as requested by the client. During the setup process, we will assist with installing the tank, placing and connecting equipment, and filling the tank with water. Our setup services do not include the purchase or delivery of livestock or materials (such as rocks, plants, or substrate) unless specified in writing. -
Livestock Health
While we take every precaution to ensure the safety of your aquarium's inhabitants, First Due Aquatic Rescue, LLC is not a veterinary service and is not liable for any damage, injury, or death of fish, plants, or other livestock in the aquarium, both during the setup process and after the tank is established. We will only set up the tank with healthy livestock purchased by the client and based on the client’s specific needs. We recommend that clients ensure their livestock are in good health prior to setup. Fish deaths may occur due to a variety of factors outside our control, and we are not responsible for any loss of livestock. -
Equipment & Tanks
We are not responsible for any damage to or malfunction of the client's aquarium equipment (e.g., pumps, filters, heaters, lights, etc.), either during setup or after the completion of our services. It is the client’s responsibility to ensure that all equipment is functioning correctly, properly sized for the tank, and in good condition before our visit. Any pre-existing issues with equipment should be disclosed prior to setup. -
Water Quality & Chemical Treatments
During setup, we will perform water tests and add chemicals, conditioners, or additives as needed to balance water parameters. However, we are not liable for any adverse effects of water changes, chemical treatments, or additives, especially if the client fails to inform us of any specific water quality issues or tank needs. We recommend that the client continue to monitor water parameters regularly after setup and seek professional advice when necessary. -
Livestock Introductions
We are not responsible for the health or survival of livestock introduced into the tank after setup. The client is responsible for the ongoing care, feeding, and monitoring of all livestock. First Due Aquatic Rescue, LLC is not liable for any deaths, injuries, or diseases that may occur after the tank is set up and livestock are introduced. This is due to the fact that livestock health is influenced by factors outside of our control. -
Liability Waiver
By engaging First Due Aquatic Rescue, LLC for aquarium setup and cleaning services, the client agrees to waive any claims for damages to livestock, aquarium equipment, or the tank itself, except in cases of gross negligence or intentional misconduct on the part of our staff. The client acknowledges that they understand the nature of aquarium setup and maintenance and accept responsibility for any issues that may arise outside of our scope of service. -
Tank Crashes & System Failures
The client acknowledges that aquarium system crashes or failures can occur due to factors beyond our control, such as fluctuations in water parameters, equipment malfunction, or unforeseen external influences. These factors may include, but are not limited to:- Equipment Malfunctions such as pumps, filters, heaters, or lights breaking down.
- Water Parameter Fluctuations such as sudden changes in temperature, pH, salinity, or spikes in ammonia, nitrites, or nitrates.
- Livestock Health Issues such as disease outbreaks or incompatible species causing stress or aggression.
- Human Error such as improper care, incorrect water changes if client decides to perform own water changes in between services, or failure to follow maintenance advice.
- External Environmental Factors like temperature extremes, power outages, or chemical contamination including but not limited to (oils, copper, other contaminants)
- Unforeseen Circumstances such as electrical failures, natural disasters, or biological events that disrupt the tank’s ecosystem.
Unless caused by gross negligence or intentional misconduct on the part of First Due Aquatic Rescue, LLC, we are not liable for any system crashes or failures that occur between services. The client accepts that such events are part of the natural risks associated with aquarium ownership.

Limitations of Service
Our setup and maintenance services are limited to routine tasks such as tank installation, cleaning, and equipment checks. We do not guarantee the performance or longevity of the aquarium or its components after our setup services. The client acknowledges that ongoing care, water testing, and proper tank management are required to ensure the health and function of the aquarium. -
Client Responsibility
The client is responsible for ensuring the safety of their property, livestock, and equipment during and after our setup services. This includes maintaining stable tank conditions, ensuring equipment is functioning properly, and monitoring the health of the livestock after setup. The client is also responsible for ensuring that any specific tank needs or requests are communicated before the setup begins, such as maintaining salinity due to evaporation and daily or suggested feedings. The client acknowledges that there is a level of responsibility in aquarium ownership, similar to caring for any other pet, and agrees to follow the advice and guidelines provided by First Due Aquatic Rescue, LLC. The client should make every reasonable effort to adhere to the aquarium care plan provided to avoid disruptions or issues with the tank’s ecosystem. - Written Agreement
Before any work or consultation begins, the client and First Due Aquatic Rescue, LLC will provide a written work order detailing the tasks to be completed. The client acknowledges and agrees to the liabilities stated above by signing the work order. Once signed, the waiver of liability will be in effect for all services rendered.
